Agreement to Terms

By accessing or using the Rhyva mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our App.

1. Description of Service

Rhyva is a menstrual health tracking application that provides:

• Menstrual cycle tracking and predictions
• Symptom and mood logging
• Personalized nutrition, skincare, and exercise recommendations
• Health insights based on your cycle data
• Reminders and notifications (optional)

2. Medical Disclaimer

The information and predictions provided by Rhyva are for informational and educational purposes only. They should not be relied upon for:

• Contraception or family planning decisions
• Diagnosing medical conditions
• Making medical treatment decisions
• Replacing professional medical advice

Always consult with a qualified healthcare provider for medical advice and before making any decisions related to your health.

3. Eligibility

To use Rhyva, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the App under applicable laws

If you are under 18, you represent that you have your parent's or legal guardian's permission to use the App.

4. User Accounts

When you create an account with Rhyva, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach

5. Subscription and Payments

Rhyva offers both free and premium subscription plans:

• Free Plan: Basic cycle tracking and limited features
• Premium Plan: Full access to all features, personalized recommendations, and advanced insights

For premium subscriptions:

• Payments are processed through the Apple App Store or Google Play Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Cancellation takes effect at the end of the current billing period
• Refunds are subject to the policies of Apple or Google, as applicable

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble the App
• Share your account credentials with others
• Use the App to harm, harass, or exploit others
• Transmit any malicious code or content

7. Intellectual Property

All content, features, and functionality of Rhyva—including but not limited to text, graphics, logos, icons, images, audio, software, and algorithms—are owned by Rhyva or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. User Content

You retain ownership of any data or content you input into the App. By using Rhyva, you grant us a limited license to use your data to:

• Provide and improve our services to you
• Generate personalized recommendations and predictions
• Create anonymized, aggregated insights (which cannot identify you)

9. Limitation of Liability

To the maximum extent permitted by law:

• Rhyva is provided "as is" without warranties of any kind
• We do not guarantee the accuracy of predictions or recommendations
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for the App in the past 12 months

10. Indemnification

You agree to indemnify and hold harmless Rhyva, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

11. Termination

We may suspend or terminate your access to the App at any time, with or without cause or notice. You may also delete your account at any time through the App settings.

Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination will remain in effect.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email. Your continued use of Rhyva after such modifications constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Delaware.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
